Scholtz Law focuses on real estate litigation, estate planning and probate administration of decedent’s estates. Anne is a Louisville native and attended Ballard High School, the University of Kentucky and the University of Louisville’s Louis D. Brandeis School of Law. In her free time, Anne enjoys reading, practicing yoga, walking her Golden retriever and listening to music. Anne and her husband, Mark, also enjoy watching Anne’s two sons compete in swim meets and tennis tournaments. Anne is involved with many volunteer organizations and is a member
of the Louisville Committee on Foreign Relations, the Greater Louisville Association of Realtors, the Louisville Independent Business Association and the Louisville and Kentucky bar associations. She has also served as Jefferson Circuit Court Special Master Commissioner and as a Jefferson Circuit Court Warning Order Attorney.

Real Estate Litigation

We represent clients involved in disputes involving real property. We draft leases and handle evictions (both residential and commercial), represent individual lenders in foreclosures of contracts for deed or other financing arrangements, provide counsel to condominium and homeowners associations (whether managed by volunteers or professional property management companies), file mechanic’s liens and pursue foreclosure and collection actions when a tradesperson does not get paid. We also represent parties in partition actions to sell jointly owned property, issues relating to ownership, adverse possession and encroachments on real estate and disputes between parties to a contract to sell or purchase real estate.

Estate Planning

It is important to have a skilled attorney prepare your estate plan. Proper drafting and correct execution of the documents are essential to ensure that your property passes to your loved ones as you wish. A thorough review of your assets, including life insurance and retirement plans, is vital to a successful estate plan. We meet with clients to determine their individual needs and wishes with respect to wills, trusts, powers of attorney and living wills/advance directives. We help clients explore their many options in planning how to leave their assets to their intended beneficiaries and understand how to use estate planning as a resource for minor children.

Probate Administration

We support families dealing with the legalities of the transfer of assets and payment of debts when a loved one has passed away. Sometimes, the most important part of probate administration is determining the best legal procedure to distribute assets and pay debts. We guide clients through the process of obtaining the greatest possible amount of assets for the family while satisfying the legal obligations to creditors. In the event of a dispute, we resolve issues and wrap up the estate administration as quickly and smoothly as possible while striving to maintain the family relationships.
